1. Who these terms are with

This website is operated by Muronah Human Resources and Management Consultancy LLC OPC, a limited liability company, one person company, licensed in the Emirate of Abu Dhabi, United Arab Emirates, with its registered office at Dar Al Salam Building, Corniche, Abu Dhabi, United Arab Emirates. In these terms we call it “Muronah”, “we” or “us”, and we call you “you”.

2. Acceptance

By accessing or using this website you agree to these terms. If you do not agree to them, please do not use the website. If you use the website on behalf of an organization, you confirm that you have authority to bind that organization to these terms.

3. Changes to these terms

We may amend these terms at any time by posting an amended version on this page. The version and effective date appear at the top. Your continued use of the website after an amended version is posted constitutes acceptance of it. Please check this page from time to time.

4. Intellectual property

All content on this website, including text, layout, graphics, the Muronah name and logo, the structure of our three pillars, our assessment instruments, our simulation designs and our course materials, is owned by Muronah or licensed to us, and is protected by UAE Federal Decree-Law No. 38 of 2021 on Copyright and Neighbouring Rights, UAE Federal Decree-Law No. 36 of 2021 on Trademarks, and equivalent laws in other jurisdictions.

You may view this website, and print or download extracts for your own personal or internal business reference. You may not otherwise reproduce, adapt, distribute, publish, license, sell or commercially exploit any part of it, or use it to develop a competing product or service, without our prior written consent.

HeartMath is a registered trademark of its respective owner. Any other third party names or marks referred to on this website remain the property of their owners, and their use does not imply any endorsement.

5. Acceptable use

You agree not to:

• use the website for any unlawful purpose, or in breach of UAE Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes;
• attempt to gain unauthorized access to the website, its server, or any connected system or database;
• introduce any virus, worm, logic bomb or other material that is malicious or technologically harmful;
• attack the website by way of a denial of service attack;
• scrape, harvest or systematically extract content from the website, or use automated means to access it other than a search engine operating in the ordinary way; or
• submit false, misleading or third party personal data through any form on the website.

We may suspend or withdraw access to the website, without notice, where we reasonably believe you have breached this section.

6. The readiness check

The readiness check is an indicative self assessment tool. It is provided for general information and reflection only.

• It is not a psychometric instrument. It has not been standardized, normed or independently validated.
• It produces a score derived arithmetically from the answers you give. Its accuracy depends entirely on the accuracy of those answers.
• It is not a diagnostic tool of any kind, and it is not an assessment of any individual’s health, capability, performance or suitability for a role.
• It must not be used as a basis for any employment, promotion, disciplinary, remuneration or other decision affecting any individual.

You are responsible for the answers you give and for any use you make of the result.

7. No professional advice

The content of this website, and the result of the readiness check, are provided for general information. They do not constitute professional, financial, investment, legal, medical, psychological or therapeutic advice, and they must not be relied on as such.

Our programs are practical work on self regulation, decision making and financial capability. They are not therapy, counselling or psychological treatment, and they are not a substitute for care from a qualified health professional. If you are concerned about your mental or physical health, please consult a qualified professional.

Nothing on this website constitutes financial or investment advice, or a recommendation to enter into any transaction.

8. Services are governed by a separate contract

This website describes our services. It is not an offer capable of acceptance and it does not create any obligation on us to provide services to you. Where we agree to provide services, that engagement will be governed by a separate written contract between Muronah and the client. Where there is any conflict between that contract and these terms, the contract prevails in respect of the services.

9. Third party links and services

This website may link to third party websites, and may embed third party services such as a scheduling tool. Those links and services are provided for convenience. We do not control them, we do not endorse them, and we accept no responsibility for their content, availability or privacy practices. Your use of them is governed by their own terms.

10. Availability

We do not guarantee that this website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or any part of the website for business or operational reasons, and we will try to give reasonable notice where we do.

11. Disclaimers

To the fullest extent permitted by applicable law, this website and its content are provided on an “as is” and “as available” basis, without warranty of any kind, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, accuracy, or non infringement.

Statements on this website about outcomes achieved in past programs describe results measured in those programs. They are not a promise, guarantee or representation that any particular result will be achieved in your organization, which depends on factors outside our control.

12. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of the United Arab Emirates.

Subject to the paragraph above, and to the fullest extent permitted by applicable law:

• we exclude all liability arising out of or in connection with your use of, or inability to use, this website;
• we are not liable for any loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of data, or any indirect or consequential loss, however arising; and
• our total aggregate liability arising out of or in connection with this website, whether in contract, tort including negligence, or otherwise, is limited to one thousand United Arab Emirates dirhams (AED 1,000).

This section does not affect our liability under any separate written contract for services, which is governed by that contract.

13. Indemnity

You agree to indemnify us against any loss, damage, cost or expense, including reasonable legal fees, that we incur arising out of your breach of these terms or your unlawful use of this website.

14. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

15. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These terms are personal to you and you may not assign them without our written consent. There is no partnership, agency or joint venture between us.

16. Governing law and jurisdiction

These terms, their subject matter and their formation are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Abu Dhabi. You and we agree that the courts of Abu Dhabi, United Arab Emirates have exclusive jurisdiction over any dispute or claim arising out of or in connection with them.
